Sales conditions and refunds
3DG Software · last updated: [DATE]
Draft. This is a working draft: it must be reviewed by a lawyer and by an accountant before publication. The competent court and the date are still to be filled in.
1. Who sells
Sales are handled by Paddle (Paddle.com Market Ltd) acting as merchant of record: Paddle is the seller towards you, collects the payment and the taxes, issues the invoice and handles refunds under its own terms.
The software is licensed by Guido Bazzotti, trading as “3DG”, VAT IT01914500200, support@3dg.it, under the Licence Agreement.
2. What you buy
A perpetual licence to use the software shown on the product page, for the platform you choose when buying (3ds Max, Cinema 4D, Rhino or SketchUp), valid on two registered computers and usable on one at a time, as described in the Licence Agreement. The price includes bug-fix updates and minor versions.
A licence for one platform does not cover the others: if you work with two programs you need two licences.
The solve runs on your own computer. Your photographs and models never leave it. An internet connection is needed to activate the licence and for the periodic check the software performs from time to time: if it cannot connect it keeps working for 72 hours, then stops until a check succeeds.
If your studio network prevents the 3D program from reaching the internet, please check that you can allow it before buying. The free trial is there for this too.
3. Price and payment
The price is the one shown on the product page when you order. Prices are stated excluding local taxes: the tax applicable in your country is calculated and added by Paddle during checkout. Payment uses the methods Paddle offers (credit card, PayPal and others depending on the country).
The licence key and the download link are sent to the order email address right after payment.
4. Free trial
Before buying, a 10-day free trial with every function active is available, with no credit card: please use it to make sure the software suits you and works on your computer.
5. Right of withdrawal
If you are a consumer resident in the European Union you have the right to withdraw within 14 days of purchase. As this is digital content delivered immediately, the right of withdrawal is lost if at the time of ordering you expressly consent to immediate performance and acknowledge losing that right (Directive 2011/83/EU, Art. 16(m)). Paddle asks for this consent at checkout.
6. Refunds
Regardless of the above: if within 14 days of purchase the software does not work on your computer for reasons attributable to us, and we cannot solve the problem, we refund the full amount.
How to ask for a refund:
- write to support@3dg.it from the email address used for the purchase, describing the problem;
- we try to solve it first: nearly always it is installation, activation, or a network blocking the connection;
- if we cannot, the refund is issued through Paddle and goes back to the payment method you used, normally within a few working days.
We do not refund a purchase made by mistake for the wrong platform once the software has been activated: write to us and we will swap the licence for the right program, at no cost.
You may in any case request a refund directly from Paddle under its own buyer terms, Paddle being the seller.
7. Delivery and activation
Delivery is electronic: download page and licence key by email. Activation needs an internet connection and registers the computer on the licence. Two computers can be registered; you can release one from the software's own panel in order to register another. Replacing a computer that can no longer be released (failure, reinstall, hardware change) is requested by email.
8. Support
Support is requested at support@3dg.it from the address used for the purchase. It covers installation, activation and defects of the software; it does not cover training, the quality of your photographs or modelling.
9. Warranty and liability
The exclusions and limitations of the Licence Agreement apply. Consumers keep their statutory rights on the conformity of digital content.
10. Law and jurisdiction
Italian law; courts of [COURT], without prejudice to the consumer's forum.
